This is an interesting wee boundary dispute in it's infancy.... Stuff - 8-Feb-2018
With each party appearing to be unsure of their rights - initially relying on Council to make a ruling on what should happen (!) - this poses some interesting questions: - what would your advice as a Professional Surveyor (qualified in dealing with things related to boundaries) be if you were approached for comment?
- could/should the landowners having to put up with the temporary supports charge an occupation fee to the owner of the chapel? (Council do that for temporary fencing supports in the road reserve)
- what would happen if the owners of the land physically removed the portions of the timberwork supports as they would seemingly have the right to do?
- how long should a landowner be prepared to put up with such an intrusion?
- why is it that in these situations it will likely be the legal fraternity that would benefit most from an involvement to "resolve" the issue?
