This older report Stuff - 13-Feb-2018 introduces a challenge to the QEII National Trust Open Space Covenant system - one that has seen over 4400 parcels of land nationwide that contain significant native biodiversity (bush, wetland, historic, archaeological areas) protected FOREVER. The challenge follows on from a change in ownership and thus a change in conservation value tolerance. It was also centered on a legal technicality, but the ordeal has cost the Trust a significant amount of money to fight the challenge. The benefits to the Trust (and the other landowners with OSC thereon) in defending this challenge is to preserve the intrinsic and fundamental values of protecting a portion of land in perpetuity. The Supreme Court decision announced recently has resulted in a "WIN" for the QEII National Trust. This will certainly set (yet another) valuable precedent in the legal system.
