Article by Mick Strack:- Survey & Spatial NZ - Magazine - Issue 103 - Nov2020 (pg37) A very interesting read..... And one that (should) generate plenty of discussion with Surveyors including but not limited to:- - diminution of the importance of the age of the stone wall fence (circa 130yrs)
- definition that a stone wall is a fence (s2 Fencing Act 1978)
- noting the obvious point that a fence too has a not insubstantial physical width and is a structure and (at least) partly straddles a boundary
- loss of pragmatism regarding the structures initial intent; purpose; and adequacy for some prolonged time to date
- a question as to what was the real purpose of the challenge to the use of the land beneath to stone wall (up to the boundary at least)
- what about a counter-claim of adverse possession?
