Waipori Falls Village, which is 60km from Dunedin, consists of 33 properties – some of which date from when workers built the nearby hydroelectric scheme. That power scheme was sold by the Dunedin City Council to TrustPower in 1998, which followed the sale of many of the properties a year earlier.

Two of the four owners of the townhouses in Hankey St, Mt Cook, Wellington, went to the High Court to break the impasse over how they should deal with a retaining wall that an engineer thought was in danger of imminent collapse. Dysfunctionality had led to an impasse, Justice Christine Grice said in her decision.

Its a wonder there aren't more of these sorts of disputes around retaining walls. In this case wouldn't it be the resonsibility of the property that built the wall to maintain it. There is a strong case for easements along retaining walls so that the responsibilities can be clearly laid out.
