Neighbours’ dispute leads to shipping containers blocking sea viewsStuff - Napier: 26-Mar-2024An elderly couple who live beside the sea near Napier have had their views blocked for the last four years by neighbours who’ve stacked shipping containers, car bodies and tarpaulins directly in front of their home. It’s an act a Judge has labelled “malicious” and “reprehensible“. The neighbours who placed the containers say the situation arose from the elderly couple trying to dictate to them what they can and can’t do on their property. There is no law that recognised a person’s right to a view. There is no actionable nuisance for obstruction of a view and that has been the case for centuries. However, the Judges view was that although the landowner's behaviour throughout this entire matter has been reprehensible, "he is entitled to judgment" and is within his rights.
